Legal Basis for Electropathy Practice in India
BEMS Certificate holders who have successfully completed the 4.5-year certification course and are registered with N.E.H.M. of India, New Delhi, are authorized to practice Electropathy throughout India, subject to the following supporting legal orders and constitutional provisions:
- Indian Constitution Article 19(1)(g): This article guarantees the fundamental right to practice any profession or carry on any occupation, trade, or business, subject to reasonable restrictions.
- Order of the Hon’ble Delhi High Court, dated 18.11.1998: This order provides a foundational judicial basis for the education and practice of Electropathy Under Nehm of India.
- Notification, Government of Delhi, dated 20.06.2003: This notification provides a specific administrative direction for electropathy practice and education.
- Policy Decision Order, Government of India, dated 05.05.2010: This order outlines the government’s policy regarding the education and practice of Electropathy.
- Order of the Hon’ble Supreme Court of India, dated 22.01.2015: This order acknowledges the Supreme Court’s position that Electropathy medical practice is not explicitly banned, subject to Central Government regulatory guidance.
- Orders of the Hon’ble High Court of Madras, dated 28.11.2016, 16.08.2022, and 05.10.2023: These orders provide further judicial support for the practice of Electropathy within the Madras High Court’s jurisdiction.
